These Terms and Conditions (“Terms”) govern all products and services provided by JEM Guns, LLC (“Company”). By placing an order, requesting a quote, or purchasing products, Customer agrees to these Terms.


1. Scope of Products and Services

Company manufactures and sells firearm components and related products (“Products”) and may provide associated machining or manufacturing services (“Services”).

Unless otherwise agreed in writing, Company controls the design, material selection, and manufacturing process for its standard Products.


2. Orders and Acceptance

All orders are subject to acceptance by Company. These Terms supersede any conflicting terms in Customer purchase orders or other documents unless expressly agreed to in writing.


3. Materials and Manufacturing

Company sources materials from reputable suppliers and manufactures Products in accordance with internal specifications and quality standards.

Customer acknowledges that all materials and manufacturing processes involve inherent variability, and product performance depends on application, use, and maintenance.


4. Limited Warranty

Company warrants that Products will:

  • Conform to Company specifications at the time of shipment
  • Be free from defects in workmanship under normal use

Company’s sole obligation under this warranty is limited to repair, replacement, or refund, at its discretion.


5. Warranty Disclaimer

EXCEPT AS EXPRESSLY PROVIDED ABOVE:

  • All other warranties are disclaimed, including:
    • Merchantability
    • Fitness for a particular purpose

Company does not warrant:

  • Performance in any specific application
  • Compatibility with third-party components
  • Results of improper installation, misuse, or modification

6. Customer Responsibility and Use

Customer is solely responsible for:

  • Proper installation and assembly
  • Safe handling, storage, and maintenance
  • Ensuring compatibility with other components
  • Compliance with all applicable laws and regulations

Customer acknowledges that Products may be used in firearms or related systems, which involve inherent risks if improperly used.

6A. Professional Installation Requirement

All Products must be installed, fitted, and inspected by a qualified gunsmith or licensed professional experienced in firearm assembly.

Improper installation or fitting may result in product failure, firearm malfunction, property damage, serious injury, or death. Company shall not be responsible for any damages or injuries resulting from improper installation, modification, or use of its Products.

Failure to have Products installed by a qualified gunsmith voids any applicable warranty and releases Company from any liability associated with the use of the Product.


7. Assumption of Risk

Customer assumes all risks associated with:

  • Assembly and integration of Products
  • Use in any firearm or mechanical system
  • Improper handling, maintenance, or modification
  • Use outside intended parameters

8. Indemnification

Customer agrees to defend, indemnify, and hold harmless Company and its owners, officers, employees, and agents from any claims, damages, liabilities, or expenses (including attorneys’ fees) arising from:

  • Improper installation, use, or modification
  • Integration with other components
  • Failure to follow applicable laws or safe practices
  • Any use of the Products after delivery

9. Limitation of Liability

To the maximum extent permitted by law:

  • Company’s total liability is limited to the amount paid for the Product giving rise to the claim
  • Company shall not be liable for:
    • Consequential, indirect, incidental, or punitive damages
    • Lost profits or business interruption
    • Product recall costs
    • Personal injury or property damage resulting from misuse or improper application

10. Inspection and Acceptance

Customer must inspect Products upon receipt. Any claims for defects or nonconformance must be made within 10 days of delivery. Failure to notify Company within this period constitutes acceptance.


11. Returns and Refund Policy

Eligibility for Returns

  • Returns are accepted within 60 days of the purchase date
  • Items must be unused, in original condition, and in original packaging

Non-Returnable Items

  • Custom-made or special-order parts are non-returnable unless defective upon receipt
  • Items altered, modified, or damaged by the Customer are not eligible for return

Return Authorization (RMA Required)

  • Customers must obtain a Return Merchandise Authorization (RMA) before returning any item
  • Returns without an RMA may be refused or subject to additional fees

Return Shipping

  • Customer is responsible for return shipping unless due to Company error or defect
  • Trackable and insured shipping is recommended, as Company is not responsible for lost returns

Inspection and Resolution

  • Returned items will be inspected upon receipt
  • If approved, Company will attempt to repair or replace within 30 days
  • If repair or replacement is not possible, a refund will be issued within 30 days to the original payment method
  • Refunds exclude original shipping unless the return is due to Company error

Exchanges

  • Exchanges are not offered. Customers must return the item and place a new order

Damaged or Defective Items

  • Customer must notify Company promptly upon receipt of any damaged or defective item

Restocking Fees

  • A restocking fee may apply to non-defective returns
  • Fees are determined on a case-by-case basis

12. Compliance with Law

Customer is responsible for ensuring all purchases, possession, and use of Products comply with applicable federal, state, and local laws.


13. Right to Refuse Service

Company reserves the right to refuse service or cancel orders at its discretion, including where use may violate laws or present unreasonable risk.


14. Governing Law and Venue

These Terms are governed by the laws of the State of Texas. Venue shall lie in Williamson County, Texas.


15. Limitation on Claims

Any claim must be brought within one (1) year from the date of purchase.


16. Entire Agreement

These Terms, together with any applicable order confirmation, constitute the entire agreement between the parties.
